The end user license agreement and terms of service for ReadyDeck.

1. Acceptance

These Terms & End User License Agreement ("Terms") are a legal agreement between you and Zellgo International LLC, a Connecticut limited liability company ("Zellgo," "we," "us"), governing your use of the ReadyDeck applications, updates, and this website (together, the "App"). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

If you use the App on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes it.

2. License

Subject to these Terms and the rules of the app store from which you obtained the App, Zellgo grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices that you own or control, for your own personal or internal household use.

The App is licensed, not sold. This license does not include any right to receive future versions, although we may provide updates at our discretion.

3. Restrictions

You may not, and may not permit anyone else to:

  • Copy, distribute, sublicense, rent, lease, lend, sell, or otherwise commercially exploit the App except as expressly permitted by these Terms.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of the App, except to the extent a restriction is prohibited by applicable law.
  • Modify, adapt, translate, or create derivative works of the App.
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices.
  • Bypass, disable, or circumvent any purchase, entitlement, security, or access-control mechanism.
  • Use the App in violation of applicable law, or to infringe the rights of another person.
  • Use the App to provide emergency response, medical, or other professional services for third parties.

4. Ownership

The App, including its software, design, text, graphics, logos, and the ReadyDeck name and house mark, is owned by Zellgo or its licensors and is protected by intellectual-property laws. No rights are granted except those expressly stated in these Terms. All rights not expressly granted are reserved.

5. Your content

You retain ownership of the inventory records, household profiles, documents, plans, and other information you enter into the App ("Your Content"). Because ReadyDeck stores Your Content locally, Zellgo does not receive or claim a license to it.

You are responsible for Your Content, including its accuracy, legality, and the consequences of recording health information about other people. Do not place content in the App that you do not have the right to store.

6. Emergency and safety disclaimer

ReadyDeck is not an emergency service.

The App does not detect emergencies, summon help, monitor conditions, or provide live instructions. It is a record-keeping and planning aid. In an emergency, call your local emergency number and follow the instructions of local authorities and qualified professionals.

ReadyDeck is not a substitute for medical care, professional emergency planning, building or fire codes, or official government guidance. Recommended items, readiness percentages, coverage views, and reminders are informational estimates generated from the information you enter. They may be incomplete, out of date, or unsuitable for your circumstances. Always verify important information against current official sources.

You are solely responsible for your preparedness decisions and for the physical condition, storage, and use of any supplies you keep.

7. Purchases

Some features require a one-time in-app purchase ("ReadyDeck Pro"). Purchases are processed by the Apple App Store or Google Play and are subject to that platform's terms and payment policies. Prices are shown by the store before you confirm a purchase.

Entitlements are tied to the store account used for the purchase and can be restored through the platform's restore mechanism. Refund requests must be made to the platform that processed the purchase, in accordance with its policies. Zellgo does not process payments and does not receive your payment-card details.

8. Updates and availability

We may release updates, change features, or discontinue parts of the App. We do not guarantee that the App will always be available, compatible with every device or operating-system version, or free of errors. Because the App is local-first, your existing local data does not depend on a Zellgo server, but operating-system changes, device loss, or uninstallation can affect access to it.

9. Local data and backups

You are responsible for creating and safeguarding backups. The App may let you protect backups with a password; if you lose that password, Zellgo cannot recover the backup or its contents. Exported PDFs, CSVs, and playbook files are stored where you choose to save or send them and are not protected by Zellgo. See the Privacy Policy for more information.

10. Third-party services

The App may let you open links to third-party websites, such as official emergency-management sources, or use platform services such as app stores and operating-system features. Zellgo does not control those services and is not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Zellgo does not warrant that the App will be uninterrupted, error-free, secure, or that any information, recommendation, or readiness calculation will be accurate or suitable for your situation.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms excludes a warranty or condition that cannot lawfully be excluded.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZELLGO AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZELLGO'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ZELLGO FOR THE APP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD 50).

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where such limitation is prohibited.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Zellgo and its members, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the App, Your Content, or your violation of these Terms or applicable law.

14. Termination

These Terms remain in effect until terminated. You may terminate them by uninstalling the App and stopping use of the website. We may suspend or terminate your license if you materially violate these Terms. Upon termination, the license ends, but the sections that by their nature should survive—including ownership, disclaimers, limitation of liability, indemnification, and governing law—will continue to apply.

15. Governing law

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-law rules. Subject to any mandatory consumer-protection rights, you and Zellgo agree to the exclusive jurisdiction and venue of the state and federal courts located in Connecticut for any dispute arising out of or relating to these Terms or the App. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. App store terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and Zellgo only, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any claims relating to the App, including product-liability, consumer-protection, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with the App Store terms and any applicable usage rules.

If you downloaded the App from Google Play, you must comply with the Google Play Terms of Service. Those terms apply in addition to these Terms; if they conflict with these Terms regarding your use of the store, the store terms control to the extent required.

17. Changes to these terms

We may update these Terms as the App evolves. The effective date at the top of this page will be revised, and material changes will be posted on this page. If you do not agree to updated Terms, stop using the App. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
